Teacher Jailed For Having Sex With Student In Her Home And Car Park.
The District Court heard she groomed a 17-year-old boy before having unlawful sex with him numerous times including at her house, at his family’s home and in public areas including in a lift and in a city car park.
Judge Liesl Chapman said Mackay drank alcohol and smoked cigarettes and cannabis with the victim and bought him expensive presents.
“In light of what you were doing and the way you were doing it, it is evident to me that you could not have been thinking straight,” Judge Chapman said.
Judge Chapman said Mackay’s offending had a devastating impact on the victim and his family.
“The victim’s mother said she does not pity you because you are a grown woman, a teacher, a mother and a wife who she says manipulated her son’s emotions to meet your own selfish needs,” she said.
“Your behaviour causes a feeling of outrage, quite rightly, in the community.
“Your behaviour was manipulative and unforgivable.”
Mackay wept as she was sentenced to four years and five months in prison.
The court heard a psychiatric assessment found Mackay was at a low risk of sexual reoffending and that she was sorry for the pain and suffering she had caused her victim and his family.
However, Judge Chapman said suspending the sentence would not adequately deter others from engaging in such behaviour.
She said Mackay’s offending was a gross breach of trust.
Judge Chapman said she understood “jail would be difficult and crushing” and imposed a non-parole period of two years and one month.
As she was taken into custody, Mackay told her family who were visibly upset, that she loved them.

Speaking to Vanguard, yesterday, after a media-gender sensitive programme organised by INEC in Lagos, INEC’s Deputy Director on Gender, Mrs. Blessing Obidegwu, said the Professor Yakubu Mahmood-led electoral commission is putting all measures in place to make the forthcoming elections the most credible in the nation’s history.
“INEC is doing a lot to make 2019 most credible. We started with planning. We have looked at our processes and plans, also looked at the technology we will deploy and we are engaging stakeholders like political parties, civil societies and the media. We appeal to other stakeholder to be part of making 2019 elections the most credible ever as the commission cannot do it alone.

“On the issue surrounding the Electoral Act (which President Muhammadu Buhari, for the fourth time refused to assent to the amendment bill), the commission has plans of meeting with stakeholders this week and I believe there will be a lasting solution. Kogi APC Lawmaker Loses Seat After Defecting To PDP
The Kogi State House of Assembly has declared vacant the seat of Hon. Linus Enenche, the member representing Olamaboro Constituency of the state.
The decision taken on Tuesday on the floor of the House in Lokoja followed the recent defection of Enenche from the ruling All Progressives Congress to the main opposition Peoples Democratic Party.
Enenche lost his seat following a motion moved to that effect by the House Majority Leader, Hon. Bello Hassan Abdullahi.
Abdullahi had hinged his motion on a letter transmitted to the House by the state chairman of the APC, Mr. Abdul Bello, informing the House of Enenche’s defection.
He said that the letter also stated that Enenche will be seeking a return to the house on the platform of his new party, the PDP during the 2019 elections.
By this action, Abdullahi explained that Enenche had contravened Section 109 -1 Sub Section G of the 1999 constitution as amended.
The motion was seconded by Hon Ahmed Mohammed but a member of the PDP in the house objected on grounds that there was no evidence to back the motion.
He also argued that Enenche had already dragged the APC to court over the matter.
The Speaker, Hon. Mathew Kolawole, however, overruled him and put the motion to vote.
Two of the three members present during the plenary voted yes while the only PDP member among them voted no.
Enenche, who later spoke with newsmen, described the action of his colleagues as reckless and unconstitutional.
The lawmaker who spoke on phone said that the matter was already in court, saying that declaring his seat vacant was null and void.
He alleged that the leadership of the House had refused to pay his salary and allowances for the past seven months.
Enenche said all efforts made by him to get his entitlements released proved abortive as the Speaker claimed that he had been directed not to pay him.

FG advocates alternative funding for road, housing projects
The Federal Government has advocated the need to fund the various road and housing projects in the South-South region outside annual budgetary provisions.

Minister of State for Power, Works and Housing, Mr. Mustapha Shehuri, who said this during a three-day inspection tour of projects in the South-South region, yesterday, said there was a need for other sources of funding besides the yearly budgetary provision
He said: “There is a dire need for alternative and innovative sources of funding besides the usual annual budgetary allocations. The government is presently using the SUKUK bond funding option and Public-Private- Partnerships, PPP, to bridge infrastructural gaps in the country.”
During his tour, the Minister inspected the dualisation of Lokoja-Benin Road, Section II; Okene-Auchi, Section III; Auchi-Ehor, as well as Section IV of Ehor-Benin City Road.
He also inspected the ongoing dualisation of Sapele-Ewu Road, sections I and II, Sapele-Agbor and Agbor-Ewu roads.
The minister expressed satisfaction at the level and quality of work being carried out, especially in Bayelsa State in spite of the difficult terrain.
He said this while inspecting ongoing construction works on Yenegwe-Okaki-Kolo Road and the dualisation of Yenegwe Road Junction-Kolo-Otuoke-Bayelsa Palm Road.
While in Rivers State, the Federal Controller of Works, Engr. J. O. Fadire, briefed the Minister on the progress of work on the rehabilitation of Enugu-Port Harcourt Expressway, Section IV, Aba-Port Harcourt, as well as the 39-kilometre Bodo-Bonny Road with bridges across Afa, Opobo and Nanabie Creeks, the only one to link the Ogoni people with Bonny Island.

Nigerian Army Has Committed War Crimes Against Humanity – International Criminal Court
The International Criminal Court (ICC) has said Nigerian security forces (NSF) have committed war crimes against humanity.
According to TheCable , the ICC said it has received “a total of 169 communications” from Nigeria and its assessment has shown that security forces in Nigeria have committed war crimes varying from murder, torture, and intentionally attacking the civilian population.
“Specifically, the office found a reasonable basis to believe that the NSF committed the war crimes of murder pursuant to article 8(2)(c)(i); torture, cruel treatment pursuant to article 8(2)(c)(i); outrages upon personal dignity pursuant to article 8(2)(c)(ii); and intentionally directing attacks against the civilian population,” the ICC said.
The ICC prosecutor, Fatou Bensouda, in her annual report on preliminary examination activities (2018), also said the ICC found reasonable basis to believe that Boko Haram also committed war crimes against humanity.
“Furthermore, the Office found a reasonable basis to believe that Boko Haram committed the war crimes of murder pursuant to article 8(2)(c)(i); cruel treatment pursuant to article 8(2)(c)(i) and outrages upon personal dignity pursuant to article 8(2)(c)(ii)”.
The ICC added that Boko Haram was
“intentionally directing attacks against the civilian population or against individual civilians pursuant to article 8(2)(e)(i); intentionally directing attacks against buildings dedicated to education and to places of worship and similar institutions pursuant to article 8(2)(e)(iv); pillaging a town or place pursuant to article 8(2)(e)(v); rape, sexual slavery and sexual violence pursuant to article 8(2)(e)(vi)”.
The office of the prosecutor added that the ICC met with the Attorney General of the Federation and Minister of Justice, Abubakar Malami, to further investigate eight potential cases of war crimes against humanity.
ICC said several “files pertaining to alleged violations by members of the army were submitted to the Office (of the prosecutor). These files relate to a limited extent to the two potential cases identified by the Office”.
“Of the 27 files provided to the Office, 24 either lacked information to determine their relevance for the admissibility assessment or did not appear relevant.
The ICC complained that “other information specifically requested by the Office which was assessed to be potentially relevant to the admissibility assessment has yet to be provided by the Nigerian authorities”.
The criminal court added since 2017, the Nigerian authorities appear to have “taken concrete steps toward fulfilling their primary responsibility to investigate and prosecute ICC crimes”.
“While there seems to be a tangible prospect of further proceedings against members of Boko Haram, including high-level commanders, at this stage the same cannot be said of the NSF, in particular since the Nigerian authorities tend to deny any allegation against the latter.
“While acknowledging the cooperation of the Nigerian authorities in the course of the preliminary examination, the Office will require, for the purpose of expediting its assessment, further information and evidence demonstrating that relevant national proceedings are being or intended to be conducted without delay”.
The ICC also said it is examining the farmers-herders crisis in Nigeria.
Senate stops EFCC nominations for excluding Southeast, Southsouth
• ‘It implies some geopolitical zones are the real criminals’
• Reps threaten zero allocation to aviation ministry
The Senate yesterday refused to confirm four nominees picked by President Muhammadu Buhari on the ground that the south-south and south-east regions of the country were not represented.
It also declined to confirm the appointment of nine others onto the board of the Independent Corrupt Practices and Other Offences Commission (ICPC), saying the nominations were lopsided.
Buhari had sought legislative approval for Moses Ndasule, Lawan Mamman, Galadanci Najib, and Adeleke Rafiu to serve on the board of the Economic and Financial Crimes Commission (EFCC).
The nominees were screened by the Committee on Anti-corruption and Financial Crimes, which presented its report on the floor of the chamber during plenary.
In the report presented by its chairman, Senator Chukwuma Utazi (PDP, Enugu North), the committee recommended their confirmation on the basis of their “qualification, experience and suitability” for the job.
Utazi, however, said the committee observed that the nomination excluded other geopolitical zones. “The committee observed that three out of the four nominees were from the north central, northeast and northwest geopolitical zones, with only one nominee from the southern part of the country, that is southwest.
“The committee notes that this is not in strict compliance with the Federal Character Principle as provided for in Section 14 (3) of the Constitution of the Federal Republic of Nigeria. The committee makes this observation to guide the executive in future nominations,” Utazi said.
But Senators Rabiu Kwankwanso (PDP, Kano Central) and Barau Jibrin (APC, Kano North) supported the recommendation of the committee for the nominees’ confirmation, citing their “experience and competence.”
Trouble started when Senator Victor Umeh (APGA, Anambra Central) rose to oppose the nomination on the premise that it would send more wrong signals about the fight against corruption.
Umeh said it was wrong for members of the EFCC board to be appointed from the northeast and southwest zones, which had already produced the chairman and secretary of the commission.
“Mr. President, we have continued to say that there is need to accommodate all parts of Nigeria in activities of government, particularly in appointing people into agencies of government. That has been the practice in this chamber, and on this issue of fight against corruption, the EFCC is a very important commission because the fight involves all parts of Nigeria.
“People are investigated in all parts of Nigerian and the commission cannot fight corruption to the satisfaction of all Nigerians if some parts of the country are not represented on it,” he said, urging the Senate to be “bold enough” to step down the consideration of the report and return the nomination to the presidency.
Senator Mathew Urighide (PDP, Edo South), who supported Umeh, said the exclusion of the southsouth and southeast painted a picture that people from the zones were the “real criminals” in the country. He also called on the Senate to step down the consideration of the report until it reflected federal character.
Asked by Senate President Bukola Saraki to give more information on the composition of the EFCC board, Utazi said there were six positions, including chairman and secretary.
He said the positions could go round the six geopolitical zones of the country and give everyone a sense of justice. He described the “lopsidedness” as unfair to the excluded zones.
But the Majority Leader Ahmed Lawan (APC, Yobe North) said the committee’s recommendation should be approved because it did not breach the EFCC Act, which is silent on the zones from which members should be appointed.
The session eventually turned rowdy as more senators made heated contributions to the debate. This forced the lawmakers to go into a closed-door executive session that lasted about 15 minutes.
On resuming plenary, Saraki said the senators had resolved to step down the report for further legislative work.
The House of Representatives Committee on Aviation meanwhile has threatened it would not allocate money to the aviation ministry in the 2019 budget.
The committee’s position followed the failure of Minister of Aviation Hadi Sirika to appear and account for the performance of the 2017 and 2018 budget.
The Chairman of the committee, Nkiruka Onyejiocha, said it was unimaginable that Sirika, a former lawmaker, would keep the committee in the dark on activities of his ministry.
“This has been happening over a period of time. We can no longer take it, as we must deliver on our mandate. Nobody can take us for a ride,” she declared.
